To Enter
1. Entry to the FANTASY FOOTBALL OPEN CHAMPIONSHIP and/or the FANTASY FOOTBALL OPEN CHAMPIONSHIP Q SCHOOL contest ("Contest") takes place by Internet only. You must complete the registration and entry form (an "Entrant") available at the Contest's website, www.FFOC.com. There is no limit to the number of entries by any one individual and the number of prizes that may be won by an individual is not limited in the Contest. Shared team ownership, however, is not permitted. Fees, charges and costs for Internet entries are paid using MasterCard, VISA®, American Express, or PayPal™ and must be paid, received and accepted by 2 PM CT, Thursday, September 10, 2009. Please note: The last day and time to register is 2 PM CT, Thursday, September 10, 2009, and the last draft time is 4 PM CT, Thursday, September 10, 2009.
A. The cost to play is $75 (Tier 1), $125.00 (Tier 2), or $275 (Tier 3) per FANTASY FOOTBALL OPEN CHAMPIONSHIP team for teams drafting from July 1, 2009, through 12 Midnight CT on August 20, 2009, (the "Early-Draft Package"). The cost to play is $100 (Tier 1), $150.00 (Tier 2), or $300 (Tier 3) per FANTASY FOOTBALL OPEN CHAMPIONSHIP team for teams drafting after 12 Midnight CT on Thursday, August 20, 2009, through 4 PM CT, September 10, 2009. There are 3 discount options available:
- 1.1 The 3 Team Draft Package - The total cost is $210 for a 3 $75-Team Package, $345 for a 3 $125-Team Package, and $780 for a 3 $275-Team Package. There is 1 draft in July 2009, 1 draft in August 2009 (no later than August 20, 2009) and 1 September draft after August 20, 2009.
- 1.1 The 6 Team Draft Package - The total cost is $390 for a 6 $75-Team Package, $625 for a 6 $125-Team Package, and $1,425 for a 6 $275-Team Package. There are 2 drafts in July 2009, 2 drafts in August 2009 (no later than August 20, 2009) and 2 September draft after August 20, 2009.
- 1.3. The 10 Team Draft Package - The total cost is $550 for a 10 $75-Team Package, $900 for a 10 $125-Team Package, and $2,220 for a 10 $275-Team Package. There are 3 drafts in July 2009, 3 drafts in August, (no later than August 20, 2009) and 4 drafts in September 2009 after August 20, 2009.
B. Under any of the three discount options or the Early-Draft Package above, Entrants will pay additional registration fees when one or more teams are drafted after one of the pre-designated dates above.
- 1.1 If the Early-Draft Package team does not successfully perform its draft on or before August 20, 2009, then Entrant is billed $25.00 more.
- 1.2. For the 3-Team, 6-Team, and 10-Team Draft Packages: a) If a July draft team does not draft on or before July 31, 2009, the team will be billed an additional $25.00. If this same July draft team does not draft on or before August 20, 2009, it will be billed an additional $25.00 for a total of $50.00; and b) If an August draft team does not draft on or before August 20, 2009, it will be billed an additional $25.00.
C. The cost to play is $10 per FANTASY FOOTBALL OPEN CHAMPIONSHIP Q SCHOOL team.
Your Eligibility
You must be 18 years of age or older at the time of registration to enter the Contest. PLEASE NOTE: This Contest is open to legal residents in the 50 United States, the District of Columbia, its territories, possessions and commonwealths (excluding the states of Arizona, Iowa, Louisiana, Maryland, Montana, and Vermont (the "Excluded States"), legal residents in Canada (excluding residents of the province of Quebec (the "Excluded Province")) and U.S. citizens living outside the United States. Legal residents of the Excluded States and Excluded Province may enter the Contest but may NOT win a prize, by emailing their request to enter to sportsdesk@fanball.com. Employees of Poised to Stomp, Inc., CDM Fantasy Sports Corp., WorldWinner, FUN Technologies and GSN, their employees, officers, directors, agents, shareholders and owners, each of their parent companies, affiliates, subsidiaries, advertising, promotion and fulfillment agencies (collectively the "Contest Entities") and members of their immediate family or household of each are not eligible to win prizes. Excluded Contest Entity employees and family members may play the Contest but are NOT eligible to receive any prize or anything of value from one of the Contest Entities. GAME OF SKILL: This Contest is a game of skill. Prize winners are determined by the objective criteria listed below, rules, scores, and by the skill and knowledge of each Entrant using accurate and timely real-world data from authoritative sources. TERM: This Contest begins with the football game on Thursday, September 10, 2009, and ends on Monday, December 28, 2009, spanning Weeks 1 through 16 of the pro-football season in the United States. THIS CONTEST IS VOID WHERE PROHIBITED.
Prizes
1. At the end of the FANTASY FOOTBALL OPEN CHAMPIONSHIP Contest, subject to the rules and eligibility requirements, prizes are awarded to the top teams in the Las Vegas, 1st & Goal, Red Zone, July, August, and September Brackets and to the two (2) top teams in each league as stated below in the prize table. Based on Week 15 point totals, the team owners of the top 15 eligible teams in the Las Vegas Bracket each receive a trip package to Las Vegas, Nevada, to compete in Week 16 for the FFOC grand prize and other prizes as part of the Main Event including a FFOC jacket, free entry into the 2010 FFOC Contest, subject to the then current entry requirements, and an invitation to the 2010 FFOC Contest's Main Event. The trip to Las Vegas includes a 2 night stay at a hotel selected by the Contest Entities in the Las Vegas, Nevada, metro area,round-trip coach airfare from a major city in the United States or Canada, transportation from the airport in Las Vegas to the hotel on Sunday, December 27, 2009, and admittance to the FFOC Las Vegas main event (the "FFOC Las Vegas Main Event") on Monday, December 28, 2009. In the event that the FFOC does not arrange a team owner's travel to and from Las Vegas, a $350 travel voucher for airfare or other transportation expenses to and from Las Vegas will be issued and the tavel arrangements wil be the responsibility of the team owner. In the event that a team owner is under 21 years of age, he or she may be restricted from attending the FFOC Las Vegas Main Event. If this restriction applies, the team owner will be contacted by a Contest Entities representative prior to making the trip to Las Vegas and may designate an alternative representative, subject to verification and approval of Contest Entities, for his or her team at the FFOC Las Vegas Main Event. Team owners must attend the festivities in Las Vegas in order to qualify to compete for one of the top 15 Las Vegas Bracket prizes as well as for the top September Bracket prize. Prizes are set out in the table below:

2. In addition, during the Term there is 1 Contest prize of $2,500.00 for the highest scoring league during the regular season ("Highest Scoring League Weeks 1-9"), 1 Contest prize of $2,500.00 for the highest scoring league during the entire season ("Highest Scoring League Weeks 1-16"), 1 Contest prize of $2,500.00 for the highest scoring team during the regular season ("Highest Scoring Team Weeks 1-9"), 1 Contest prize of $2,500 for the highest scoring team during the entire season ("Highest Scoring Team Weeks 1-16"), and 1 Contest prize of $3000.00 and a trip package to Las Vegas, Nevada, for the participant who refers the most teams at any of the three tiers that are registered, paid for, and drafted by new customers subject to these Rules and eligibility requirements.
3. To determine the Highest Scoring League during the Regular Season, the accumulated weekly point totals of all 10 teams in each league are added together from weeks 1 through 9 and compared. The league with the highest number of total points is awarded $2,500.00 to be shared equally among the 10 team owners in that league. In the event of a tie between different leagues, the following tie-breakers are used in this order:

7. To determine the Most Referred Teams, the accumulated Tier 1, Tier 2, and Tier 3 referred teams for each participant will be compared. The participant with the highest number of referred teams is awarded $3000.00 and a trip package to Las Vegas, Nevada. In the event of a tie between different participants, the prize will be awarded to the participant whose referred teams generated the most entry fee revenue. In the event that a tie still exists, the $3000 cash prize will be distributed equally among those who tied and a random draw will be used to award the trip package. The trip to Las Vegas includes a 2 night stay at a hotel selected by the Contest Entities in the Las Vegas, Nevada, metro area, round-trip coach airfare from a major city in the United States or Canada, transportation from the airport in Las Vegas to the hotel on Sunday, December 27, 2009, and admittance to the FFOC Las Vegas Main Event on Monday, December 28, 2009. In the event that the FFOC does not arrange the team owner's travel to and from Las Vegas, a $350 travel voucher for airfare or other transportation expenses to and from Las Vegas will be issued and the travel arrangements will be the responsibility of the team owner. Friend referral credits for a new participant are only attributable to one existing participant. In the event that two or more existing participants recommend the same new participant, the existing participant who made the referral first via the Contest friend referral link will receive the friend referral credit. A new participant is a person who has not played FFOC in the past nor who has previously registered for the current year's FFOC prior to the friend referral email having been sent to him. No friend referral credits are awarded for Q School teams nor do Q School teams count towards the $3000 most-teams-referred prizes.
8. Poised to Stomp, Inc. reserves the right to modify or cancel the Referral Bracket competition and associated prizes in the event that an insufficient number of participants qualify. Any modifications to the Referral Bracket competition will be announced by Friday, September 18, 2009.
9. *THE $1,000,000 WILL BE PAID OUT AS FOLLOWS: THE WINNER WILL RECEIVE $300,000 IN LAS VEGAS AT THE MAIN EVENT AND WILL THEN RECEIVE $70,000 PER YEAR ON THE FIRST BUSINESS DAY AFTER JANUARY 1ST OF EACH YEAR FOR THE NEXT 10 YEARS, 2011 THROUGH 2020.
10. **Each Tier 2 league winner receives $180 cash and one 2010 FFOC Tier 1 team that drafts on or before Thursday, August 19, 2010. Each Tier 1 or Tier 3 league winner receives two free entries for 2010: 1) one 2010 FFOC Tier 1 team that drafts on or before Thursday, August 19, 2010, and 2) one 2010 FFOC team at the same pricing tier as the team that finished in 1st place and drafts on or before Thursday, August 19, 2010. 11. ***Each 2nd place league finisher receives one 2010 FFOC Tier 1 team that drafts on or before Thursday, August 19, 2010.
12. At the end of the FANTASY FOOTBALL OPEN CHAMPIONSHIP Q SCHOOL Contest, subject to the rules and eligibility requirements, prizes are awarded to the top teams in the Q Bracket, the Post-Season Bracket, and to the top team in each Q School league as stated below in the prize table. Based on Week 14 bracket standings, the top 5 teams in the Q Bracket with the highest weekly point totals for Week 14 will be promoted to the Las Vegas Bracket in the FANTASY FOOTBALL OPEN CHAMPIONSHIP Contest and will receive one 2010 FFOC Tier 1 team that drafts on or before Thursday, August 19, 2010 (a $75 value). These five teams will compete in the Las Vegas Bracket during Week 15, and are eligible to become one of the top 15 teams to receive a trip to Las Vegas and compete in Week 16 for the FFOC grand prizes. If, however, a Q School team is cut from the Las Vegas Bracket based on the Week 15 standings, the Q School team will join the Red Zone Bracket for Week 16 play and is eligible for Red Zone Bracket prizes.

13. +Each top 125 finisher in the Q Bracket receives one 2010 FFOC Tier 1 team that drafts on or before Thursday, August 19, 2010.
14. In the event of a tie for 125th place in the Q Bracket or the Post-Season Bracket, all tied teams receive a 125th place prize.

Notification
Cash prizes are awarded in U.S. Dollars to one individual per team. The 15 Las Vegas Bracket cash prizes will be awarded on Monday, December 28, 2009, provided that each potential prize winner completes and signs his or her affidavit of eligibility, publicity/liability/talent release (except where prohibited by law), tax forms, and other documents, and provided that there is a clear margin of victory. Remaining winners are notified by email or regular mail within 30 days after the official final bracket results (and associated winners) are posted on the FFOC website at the end of the Contest. Failure to comply with this requirement can result in disqualification or extend the time it takes to receive his or her prize. Any prize notification returned as undeliverable may result in disqualification and selection of an alternate winner. After 12 months, any unclaimed prize is forfeited. The potential prize winner(s) are required to sign and return, within 15 days of issuance, the affidavit of eligibility, publicity/liability release, except where prohibited by law, and tax forms. The failure to return such documents within the specified time period, noncompliance with these rules, the return of any prize or prize notification or if any potential prize winner declines a prize may disqualify that prize winner and an alternate eligible Entrant with the next highest score will become the potential prize winner. Except where prohibited by law, winner's acceptance of a prize constitutes permission for the Contest Entities to use prize winner's name, photograph, likeness, statements, biographical information, voice, and address (city and state) worldwide and in all forms of media, in perpetuity, without further compensation. In the event of a dispute, entries made by Internet will be declared made by the authorized account holder of the e-mail address submitted at time of entry. "Authorized account holder" is defined as the natural person who is assigned to an e-mail address by an Internet access provider, on-line service provider or other organization (e.g., business, educational institution, etc.) that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address. Contest Entities reserve the right, at their sole discretion, to disqualify any individual who tampers with the entry process (by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of Contest Entities which corrupt or affect the administration, security, fairness, integrity, or proper conduct of this Contest), and to cancel, terminate, modify or suspend the Contest. In such event, Contest Entities reserve the right to award prizes to the eligible Entrants with the most points as of the termination date and to award the prize(s) to eligible Contest Entrants as measured by the best record (tie breakers rules will apply) in each league in the Contest as of termination date.
Entries
The Contest Entities are not responsible for and you forever waive your right to any claim against Contest Entities: a) in connection with, lost, late, incomplete, corrupted, stolen, misdirected, illegible, incomplete or postage due, entries, entrant information and affidavits; b) for any computer, telephone, cable, network, satellite, electronic or Internet hardware or software malfunctions, or unauthorized human intervention including theft or destruction or unauthorized access to, alteration of, or failure to capture the entry, entries or transactions; or c) failure of any e-mail entry or transaction to be received on account of technical problems or traffic congestion on the Internet or at any website, or any combination thereof, including any injury or damage to participant's or any other person's computer related to or resulting from participation or downloading any materials from this Contest.
Internet. If for any reason the Internet portion of the program is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the reasonable control of Contest Entities and which corrupt or affect the administration, security, fairness, integrity, or proper conduct of this Contest, Contest Entities reserve its right to cancel, terminate, modify or suspend the Contest. In such event, Contest Entities further reserve its right to award prize(s) to Entrants/potential prize winners with the most points as of the termination date and to award the prize(s) to eligible Contest Entrants as measured by the best record (tie breakers rules will apply) in each league in the Contest as of termination date.
Entries. Contest Entities are not responsible for lost, late or misdirected on-line entries or transactions, for incorrect, inaccurate or incomplete entry information whether caused by a contestant, equipment, or technical malfunction or for any human error, technical error or malfunctions. Contest Entities reserve the right to halt or modify the Contest at any time during the Contest period if events beyond their reasonable control, compromise the Contest's fairness or integrity. In the event that a scheduled football game is canceled or preempted for any reason, no points will be awarded for that week for players on those NFL teams. Contest Entities are not responsible for typographical or other human or technical errors in the offer or administration of this Contest, including but not limited to errors in advertising, the Official Rules, the selection and announcement of the prize winner(s) or the distribution of prizes.
Conduct. Contest Entities, in their sole discretion, may disqualify any Entrant from participating in the Contest, refuse to award points or prize(s), and require the return of prize(s), if Entrant engages in any conduct Contest Entities deem improper, unfair or otherwise adverse to the operation of the Contest or detrimental to other Entrants. Such improper conduct includes, but is not limited to, falsifying personal information required during Contest registration or prize claim(s), violating any term or condition stated herein, accumulating points or prizes through methods such as automated computer scripts or other programming techniques, allowing others to use the Entrant's personal information for the purpose of accumulating points or prize(s), tampering with Contest Entities' administration of this Contest, or intentionally trying to defraud, reverse engineer, disassemble, decompile or otherwise tamper with the computer programs on this website. Entrant further acknowledges that the forfeiture of any prize(s) and/or return of the prize(s) shall in no way prevent Contest Entities from instituting or assisting in the institution of other avenues of recourse such as criminal or civil proceedings in connection with such conduct.
Virus. Contest Entities reserve the right to disqualify any individual who tampers with the entry process and to cancel, terminate, modify or suspend the Contest for any reason including, but not limited to, infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures or any other reason corrupting or affecting the administration, planning, security, fairness, integrity or proper conduct of the Contest. ANY ATTEMPT BY A PARTICIPANT TO DELIBERATELY DAMAGE ANY WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, ENTRANT SHALL BE EXPELLED AND CONTEST ENTITIES RESERVE THEIR RIGHT TO SEEK DAMAGES TO THE FULLEST EXTENT PERMITTED BY LAW.
Contest Errors
The Contest Entities assume no liability and are not responsible for, and you hereby forever waive any rights to any claim in connection with, errors and/or ambiguity: a) in the Contest; b) in any related advertising or promotions of this Contest; and/or c) in these Official Rules including but not limited to errors, the selection and announcement of a prize winner or the distribution of a prize. In the event of any ambiguity or error(s) in these Official Rules, Contest Entities reserve the right to modify these Official Rules for clarification purposes or to correct any such ambiguity or error(s) without materially affecting the terms and conditions of the Contest.
Refund Policy
To withdraw your team and receive a full refund of your entry fee, you must submit your request before your 10-team league assignment and corresponding draft date and time have been confirmed. All requests must be received in writing. Please allow 30 days to receive your refund check. Once your 10-team league assignment and corresponding draft date and time have been confirmed, the league is locked and no refund will be issued.
At its sole discretion, Contest Entities reserves their right to terminate the Contest in its entirety in the event there are an insufficient number of Entrants and their teams by August 25, 2009. Upon occurrence of this event Combined Entities may refund Entrant's entry fees within 48 hours of the Contest's termination and cancel the Event or send Entrant a new entry form with newly stated prize amounts, dates, etc. This section is subject to the Release, Indemnity and Limitation of Liability sections below. For clarification, an Entrant's own travel or hotel expenses or his or her time taken off from employment are the sole responsibility of Entrant.
Official Rules
This Contest is subject to the laws of the United States and to the Official Rules, and no part of this Contest may be used in connection with any form of gambling. This is a skill Contest designed to increase consumer awareness of and interest in the Contest Entities and all aspects of the game of football and in particular, professional football. By entering the Contest, you agree to abide by the terms of the Official Rules and by the decisions of the Contest Entities, which are final on all matters pertaining to the Contest. The Official Rules are the rules posted on the Contest's website. In the event that the Contest is challenged by any legal or regulatory authority, Contest Entities reserve the right to discontinue or modify the Contest, or to disqualify participants residing in the affected geographic areas. In such event, Contest Entities shall have no liability to Entrants who are disqualified due to such an action.
Release, Indemnity and Limitation of Liability
Each entrant in the Contest, including, without limitation, the prize winners and if required their Main Event representatives, release and agree to hold harmless the Contest Entities from any and all liability for any injuries, loss or damage of any kind to person, including death, and property, arising in whole or in part, directly or indirectly, from acceptance, possession, use or misuse of a prize, participation in this Contest, including travel, hotel stay and admittance to the Main Event and participation in any activity related to this Contest. By participating in the Contest, Entrants (and in the case where there is a representative for an Entrant at the Main Event) release and agree to hold harmless Contest Entities, their directors, officers, employees and agents from any liability whatsoever for any claims, costs, injuries, losses, or damages of any kind arising out of or in connection with the Contest (including, without limitation, claims, costs, injuries and losses related to personal injuries, death, damage to or destruction of property, right of publicity and privacy, defamation or portrayal in a false light, whether intentional or unintentional), whether under a theory of contract, tort (including negligence), warranty or other theory. All participants agree to abide by the terms of these Official Rules and the disclaimers and by the decisions of Contest Entities, which are final and binding on all matters pertaining to the Contest. Contest Entities are solely responsible for enacting, administering, enforcing the rules, and maintaining the integrity of the Contest and reserve the right to review and arbitrate all league drafts and all roster changes, including blind bid and first-come-first-served free agent acquisitions, in order to uphold the integrity of the Contest and prevent collusion and reserve the right to cancel any league that they determine, in their sole discretion, exhibits collusion during the draft and/or during any point during the Contest period. The Contest, Main Event and website are not sponsored or endorsed by the National Football League. The Contest Entities assume no liability and are not responsible for, and you forever waive any rights to any claim in connection with, the selection and announcement of a prize winner, the distribution of a prize, the acceptance/possession and/or use/misuse of any part of a prize and/or any injury or damage to any Entrant's or a third person's property related to or resulting from any part of a prize or any part of this Contest.
IN NO EVENT WILL THE CONTEST ENTITIES BE RESPONSIBLE OR LIABLE FOR ANY DAMAGES OR LOSSES OF ANY KIND, INCLUDING DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL OR PUNITIVE DAMAGES ARISING OUT OF YOUR ACCESS TO AND USE OF THE SERVICE AND/OR THE CONTEST, DOWNLOADING FROM AND/OR PRINTING MATERIAL DOWNLOADED FROM THE SERVICE AND/OR THE CONTEST AND IF APPLICABLE TRAVEL TO, FROM AND THE STAY AND PARTICIPATION IN THE MAIN EVENT IN LAS VEGAS. IN NO EVENT SHALL CONTEST ENTITIES' TOTAL LIABILITY TO YOU FOR DAMAGES, LOSSES, OR FROM A CLAIM EXCEED $100.00. WITHOUT LIMITING THE FOREGOING, EVERYTHING IN THE CONTEST AND THE SERVICE INCLUDING THE PRIZES ARE PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE OR NON-INFRINGEMENT. SOME JURISDICTIONS MAY NOT ALLOW THE LIMITATIONS OR EXCLUSIONS OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES OR EXCLUSION OF IMPLIED WARRANTIES SO THAT SOME OF THE ABOVE LIMITATIONS OR EXCLUSIONS MAY NOT APPLY TO YOU.
Binding Arbitration, Governing Law and Jurisdiction
The parties waive all rights to trial in any action or proceeding instituted in connection with these Official Rules, including, without limitation, the Contest. Any controversy or claim arising out of or relating to these Official Rules and/or the Contest shall be settled by binding arbitration in accordance with the commercial arbitration rules of the American Arbitration Association. Any such controversy or claim shall be arbitrated on an individual basis, and shall not be consolidated in any arbitration with any claim or controversy of any other party. The arbitration shall be conducted in St. Louis, Missouri. THESE OFFICIAL RULES AND THE INTERPRETATION OF ITS TERMS SHALL BE GOVERNED BY AND CONSTRUED IN ACCORDANCE WITH THE LAWS OF THE STATE OF MISSOURI WITHOUT REGARD TO ITS CONFLICTS OF LAWS RULES. For any matters which are not subject to arbitration as set forth in these Official Rules and/or in connection with the entering of any judgment on an arbitration award in connection with these Official Rules and/or the Contest, the parties irrevocably submit and consent to the exclusive jurisdiction and venue of Missouri and federal courts located in St. Louis, Missouri. The parties agree not to raise the defense of forum non conveniens.
